Welcome to Travelese!

These Terms of Service ("Terms") apply to your use of Travelese's AI-powered travel planning and booking platform, including associated applications and websites at travelese.ai and chat.travelese.ai (collectively, the "Service"). These Terms form an agreement between you and Travelese ("we," "our," or "us"). By using our Service, you acknowledge and agree to these Terms.

Please note:

• We reserve the right to modify these Terms.
• Please read our Privacy Policy, which describes how we collect, use, and disclose personal information. Although it does not form part of these Terms, it is an important document you should read.
• Please read our Cookie Policy, which describes how we use cookies and similar technologies.

Who We Are

Travelese is an AI-powered travel planning and booking platform. We provide conversational AI assistance — powered by xAI's Grok language models — for researching, planning, and booking flights and accommodations. We act as an intermediary between you and third-party travel providers, facilitating bookings through our technology partner Duffel. Travelese is a separate company from xAI and Duffel.

Registration and Access

Minimum age. You must be at least 18 years old to create an account or make travel bookings through the Service. By using our Service, you represent that you meet this age requirement.

Registration. You must provide accurate and complete information to register for an account. You may not share your account credentials or make your account available to anyone else, and are responsible for all activities that occur under your account.

Anonymous access. You may use the Service in a limited demo mode without creating an account. Anonymous users are subject to restricted features including a limit of five (5) AI chat messages. Demo mode does not permit travel bookings or payment transactions. To continue using the platform beyond these limits, you must create an account and subscribe to a plan.

Logging in through a third-party service. By choosing to log in using a third-party service such as Google or X, you give us permission to access, use, and store your information from that service, as permitted by that service, which may include log-in credentials and profile information.

Traveler profile. Each registered user must maintain a primary traveler profile containing accurate personal information. This profile is used to process travel bookings on your behalf. You agree to keep your traveler profile information current and accurate at all times.

Account security. You must notify us immediately at hey@travelese.ai if you believe your account has been compromised. You will immediately take action to secure your account. We are not liable for losses resulting from unauthorized use of your account where you have failed to safeguard your credentials.

Using Our Service

What you can do. Subject to your compliance with these Terms, you may access and use our Service for personal travel planning and booking purposes.

What you cannot do. Prohibited uses of our Service include any illegal, harmful, or abusive activities, including but not limited to:

• Providing false or misleading information in your traveler profile or during the booking process
• Attempting to gain unauthorized access to our systems, other user accounts, or third-party services connected to Travelese
• Interfering with or disrupting the operation of the platform, including through automated scripts, bots, or excessive requests
• Reselling, redistributing, or commercially exploiting Travelese's services without our written permission
• Using AI features to generate content that is harmful, abusive, threatening, or that violates the rights of others
• Circumventing usage limits, subscription restrictions, or security measures
• Reverse engineering, decompiling, or attempting to extract the source code of the Service
• Using the Service or any Output to develop competing products or services

We reserve the right to suspend or terminate your account for violations of these Terms, with or without prior notice.

User Content

Your content. You may provide input to the Service, such as text messages, voice input, traveler information, and travel preferences ("Input"), and receive output from the Service, such as AI responses, travel recommendations, and itinerary suggestions ("Output"). Collectively, Input and Output are "User Content." You are responsible for User Content, including ensuring that it does not violate any applicable law or these Terms.

Ownership. To the extent permitted by applicable law, and as between you and Travelese, you retain your ownership rights to your Input. Content you create or provide through Travelese (such as notes, preferences, and traveler information) remains yours.

Our use of your content. By submitting content to Travelese, you grant us a limited, royalty-free license to use that content to provide and improve our services, including to process your travel bookings, deliver AI responses, and improve the quality of our platform.

Accuracy. AI is probabilistic in nature. Output may not always be accurate, complete, or up to date. You should independently verify critical information such as visa requirements, health advisories, travel restrictions, and booking details before relying on them.

Paid Accounts

Subscription tiers. Travelese offers three subscription tiers:

• Explorer — $15 per month ($145 per year)
• Traveler — $35 per month ($335 per year)
• Flâneur — $65 per month ($625 per year)

Each tier provides different levels of access to AI features, booking capabilities, voice mode, and monthly usage credits as described on our pricing page.

Free trial. Paid subscriptions include a three (3) day free trial. A valid payment method is required to start a trial.

Fees and payments. All subscription payments are processed through Stripe, a PCI-compliant third-party payment processor. By subscribing, you authorize Stripe to charge your selected payment method on each periodic renewal until you cancel. We will charge tax when required. If your payment is not successful, we may downgrade your account or suspend your access to the Service until payment is received.

Usage credits. Each subscription tier includes a monthly credit grant for AI usage (tokens, tool calls, voice minutes, and other metered services). Credits reset each billing cycle and do not roll over. Usage beyond your credit grant may be billed as overage at metered rates.

Booking fees. A service margin is applied to travel bookings, which varies by subscription tier (Explorer 8%, Traveler 5%, Flâneur 2.5%). This margin is included in the displayed booking price.

Price changes. We may adjust subscription prices periodically. If prices increase, we will provide thirty (30) days' notice, and the new price will apply at your next renewal, allowing you to cancel if you disagree with the change.

Cancellation. You may cancel your subscription at any time through your account settings. Upon cancellation, your subscription remains active until the end of the current billing period. Payments already made are non-refundable, except where required by law. After cancellation takes effect, your account reverts to demo-mode access limits.

Travel Bookings

Travelese as intermediary. Travelese facilitates travel bookings through Duffel, a travel technology provider that connects to airlines and accommodation providers. When you book a flight or stay through Travelese, you are entering into a contract with the underlying airline or accommodation provider. Travelese is not the travel provider and does not operate flights, hotels, or other travel services.

Booking accuracy. You are responsible for verifying all booking details — including traveler names, dates, destinations, passport information, and loyalty program numbers — before confirming a booking. Errors in traveler information may result in denied boarding, booking cancellation, or additional fees imposed by the travel provider, for which Travelese is not responsible.

Pricing. Travel prices displayed through Travelese are sourced from Duffel and the underlying travel providers. Prices may change between the time they are displayed and the time you confirm a booking. The final price is the amount confirmed at the time of booking completion.

Booking payments. Payments for travel bookings are processed through Duffel's payment infrastructure. By confirming a booking, you authorize the applicable charge to your payment method. Travel booking payments are separate from your subscription payments.

Cancellations, changes, and refunds. Cancellation and change policies are determined by the underlying airline or accommodation provider, not by Travelese. Refund eligibility, change fees, and cancellation penalties are governed by the travel provider's terms. We will make reasonable efforts to assist you with cancellation or change requests, but we cannot guarantee outcomes that depend on third-party provider policies.

Travel documentation. You are solely responsible for ensuring you have valid passports, visas, health documentation, and any other travel documents required for your trip. Travelese does not verify the validity of your travel documents or your eligibility to travel to any destination.

AI Services

AI chat. Travelese provides AI-powered conversational assistance for travel planning, powered by xAI's Grok language models. AI responses are generated based on available data and models and may not always be accurate, complete, or up to date.

Voice features. Travelese offers voice interaction capabilities, including voice input and text-to-speech output through AI voice personas (Eve, Ara, Rex, Sal, and Leo). When you use voice features:

• Voice input is processed and converted to text for the AI to respond to
• Voice data is processed in real time and is not permanently stored as audio recordings by Travelese
• Text-to-speech output is generated using xAI's voice synthesis technology
• Voice personas are AI-generated voices, not recordings of real individuals

By using voice features, you consent to the processing of your voice input as described above and in our Privacy Policy.

AI limitations. You understand and agree that:

• Output may not always be accurate. Output from our Service is not professional advice. You should not rely on Output as the sole source of truth or factual information.
• You are responsible for evaluating Output for accuracy and appropriateness before using or sharing it, particularly for travel decisions involving safety or significant financial commitment.
• Our Service may provide incomplete, incorrect, or unsuitable Output that does not represent Travelese's views.

Third-Party Services

Our Service integrates with third-party services to deliver its functionality. Your use of Travelese involves interaction with:

• Supabase — Authentication and data storage
• Stripe — Subscription payment processing and billing
• Duffel — Travel booking, fulfillment, and booking payments
• xAI — AI language model processing and voice synthesis
• Vercel — Platform hosting
• Cloudflare — Security and bot protection (Turnstile)

Each third-party service is governed by its own terms and privacy policies. Travelese is not responsible for the practices, availability, or performance of third-party services. We are not liable for any loss or damage resulting from the acts or omissions of these third-party providers.

Travelese's Intellectual Property Rights

We own our Service. We and our affiliates own all rights, title, and interest in and to the Service, including but not limited to the user interface, design, branding, documentation, and technology comprising Travelese.

Limited license. Your subscription grants you a limited, non-exclusive, non-transferable license to use the platform for personal travel planning and booking purposes in accordance with these Terms.

Feedback. To the extent you provide us any suggestions, recommendations, or other feedback relating to the Service ("Feedback"), you assign to us all rights, title, and interest in and to the Feedback. We are free to use the Feedback without attribution or compensation to you, for any purpose.

Privacy and Data Security

Privacy. We care about your privacy. By using the Service, you acknowledge that we may collect, use, and disclose your personal information as set forth in our Privacy Policy.

Security. We care about the security of your personal information. However, we cannot guarantee that unauthorized third-parties will never be able to defeat our security measures. You acknowledge that you provide your data at your own risk.

Termination, Suspension, Discontinuation

Termination or suspension. You are free to stop using our Service at any time and close your account. We may terminate or suspend your access to our Service or delete your account at any time without notice if we determine, at our sole discretion, that:

• You breached these Terms
• We must do so to comply with the law
• Your use of our Service could cause risk or harm to Travelese, our users, or anyone else
• Your account has been inactive for over a year and you do not have a paid subscription

No refund. Upon termination, you will not be entitled to any refund, except where required by law.

Discontinuation. We may decide to discontinue our Service. If we do, we will provide you notice and any applicable refund for prepaid, unused services.

Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE AND ANY INFORMATION AVAILABLE THROUGH THE SERVICE ARE PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE. YOU ACCEPT AND AGREE THAT ANY USE OF OUTPUT FROM OUR SERVICE IS AT YOUR SOLE RISK.

Indemnity

To the fullest extent permitted by law, you will defend, indemnify, and hold Travelese and our officers, directors, employees, and agents harmless from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including legal fees) arising from or related to your use of the Service, your Input, your travel bookings, or any violation of these Terms.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL TRAVELESE BE LIABLE (A) FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, TRAVEL PLANS, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICE; AND (B) TO YOU FOR ANY CLAIMS, DAMAGES, OR COSTS IN AN AMOUNT EXCEEDING THE AMOUNT YOU PAID TO US IN SUBSCRIPTION FEES DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR ONE HUNDRED U.S. DOLLARS ($100.00), WHICHEVER IS GREATER. THESE LIMITATIONS APPLY EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. WE ARE NOT LIABLE FOR LOSSES ARISING FROM TRAVEL DISRUPTIONS, CANCELLATIONS, OR CHANGES MADE BY AIRLINES, ACCOMMODATION PROVIDERS, OR OTHER THIRD PARTIES.

Some countries and states do not allow the disclaimer of certain warranties or the limitation of certain damages, so some or all of the terms above may not apply to you, and you may have additional rights.

Dispute Resolution

Class action and jury trial waiver. BY ENTERING INTO THESE TERMS, YOU AND TRAVELESE ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO BRING, JOIN, OR PARTICIPATE IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, OR OTHER REPRESENTATIVE PROCEEDING OF ANY KIND AS A PLAINTIFF OR CLASS MEMBER.

Governing law. The laws of the State of California, United States, excluding its choice of law provisions, will govern these Terms and any dispute that arises between you and us. Any disputes related to these Terms or the Service shall be brought exclusively in the federal or state courts located in California, and you consent to personal jurisdiction in those forums.

Limitations period. You must initiate any proceeding or action within one (1) year of the date of the occurrence of the event giving rise to the dispute. Otherwise, to the extent permitted by applicable law, you waive the right to pursue any such claim.

Nothing in these Terms limits your rights under mandatory consumer protection laws of your jurisdiction of residence.

General Provisions

Assignment. These Terms may not be transferred or assigned by you, but may be assigned by us without restriction.

Changes to Terms. When we change these Terms in a material manner, we will update the "Effective" date at the top of this page and notify registered users via email or in-app notification at least thirty (30) days before changes take effect. Your continued use of the Service after any change constitutes your acceptance of the new Terms. If you do not agree, you must stop using the platform and cancel your subscription.

Entire agreement. These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Travelese concerning the Service. If any provision of these Terms is deemed invalid, the invalidity of such provision will not affect the remaining provisions, which will remain in full force and effect.

Severability. If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

No waiver. No waiver of any term of these Terms will be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these Terms will not constitute a waiver of such right or provision.

European Economic Area, United Kingdom, and Switzerland Residents

If you reside in the European Economic Area, United Kingdom, or Switzerland (collectively, "Europe"):

• Governing law. You will benefit from the applicable mandatory provisions of the law of the country in which you are resident.
• Jurisdiction. You may bring a dispute in the applicable courts of the country in which you are habitually resident.
• Right of withdrawal. You have the right to close your account and withdraw from this contract within 14 days of entering into the contract. To exercise this right, contact us at hey@travelese.ai.
• Limitation of liability. Provided we have acted with professional diligence, we do not take responsibility for loss or damage unless caused by our breach of these Terms or reasonably foreseeable at the time of entering into these Terms.
